1. Definitions
HAMAE: HAMAE, established at Madeweg 3, 8386 XA Doldersum, the Netherlands, registered with the Dutch Chamber of Commerce under number 96524111, VAT identification number NL005215026B35.
Client: any natural person or legal entity that accepts an offer from HAMAE or purchases a service or product from HAMAE.
Services: all services offered by HAMAE, including individual programmes, coaching, voice and expression work, retreats, energy work, massage, embodiment, spiritual healing, readings, workshops, group sessions and concerts.
Materials: all physical and digital content made available by or on behalf of HAMAE, including texts, exercises, methods, formats, music, audio, video, images, meditations and workbooks.
2. Applicability and formation of the agreement
These terms and conditions apply to all offers, agreements, services and products of HAMAE. An agreement is formed when the client accepts an offer, makes a purchase, registers or otherwise gives written consent.
The description of a programme or journey and the written communications relating to it form part of the agreement, unless they conflict with a separately signed agreement. In that event, the separately signed agreement takes precedence.
These terms and conditions have been drawn up in Dutch and English. In the event of any difference in interpretation or meaning, the Dutch text shall prevail.
3. Nature and scope of a programme
A programme is a coherent journey and not merely a collection of separate sessions. Its value also lies in the structure and holding of the journey, preparation, interim alignment, integration, methodology, materials and HAMAE’s professional presence.
The precise content, duration, location, form, included sessions and any additional elements are set out in the offer or individual agreement. Insights and exercises may be adapted to what arises during the programme without changing the essential nature of the agreed services.
4. Duration and use
A programme or journey has the duration stated in the offer or individual agreement. Sessions, meetings, materials or other elements not used within that period expire at the end of the agreed term, unless otherwise agreed in writing or mandatory law provides otherwise.
5. Payment
The price, payment dates and any instalments are stated in the offer, invoice or individual agreement. A deposit may apply to retreats, VIP days and programmes. An agreed payment obligation remains due if the client chooses not to use, or uses only part of, the offered elements, subject to mandatory consumer rights or a different written agreement.
If payment is not made on time, HAMAE may, after granting a reasonable written period in which to remedy the default and insofar as permitted by law, suspend performance. Statutory collection-cost and interest rules remain applicable.
6. Cooling-off period for distance contracts
When a consumer concludes the agreement online, by telephone or away from business premises, the statutory rules on the cooling-off period apply. If the client expressly requests that the services begin during the cooling-off period, a proportionate amount may be payable for the part already performed if the agreement is withdrawn. Where required by law, the client will receive additional information and a model withdrawal form before entering into the agreement.
7. Rescheduling, cancellation and missed meetings
Individual sessions
An individual session may be rescheduled free of charge up to 48 hours before it starts, unless the offer or individual agreement states otherwise. If notice is given later or the client does not attend, the session may be treated as used, except where mandatory law or exceptional circumstances call for a different solution. If HAMAE needs to reschedule a session, a new date will be arranged in consultation.
Group meetings
A missed group meeting does not entitle the client to a replacement meeting or a refund, unless otherwise agreed in writing. Participants are responsible for safeguarding the confidentiality and safety of the group. If a participant’s conduct seriously or repeatedly disrupts the safety of the group, HAMAE may temporarily suspend or terminate that person’s participation following a careful assessment and subject to mandatory law.
Other activities
Separate cancellation conditions may apply to retreats, VIP days, workshops, concerts and other activities. These will be disclosed before the agreement is concluded and will then form part of the agreement.
8. Personal responsibility and results
HAMAE has an obligation to use reasonable professional efforts and does not guarantee any specific personal, business, financial, relational, creative, spiritual or health outcome. The client remains responsible for their own choices, boundaries, actions, decisions and their consequences.
The client provides information that can reasonably be considered relevant to careful and safe guidance and indicates when an exercise, touch or way of working does not feel appropriate.
9. Health, consent and scope
HAMAE’s services are complementary and do not replace medical, psychological, psychiatric, legal, financial or other specialist assistance. HAMAE does not make medical diagnoses or prescribe medication. If there is any doubt concerning health or safety, the client should consult a qualified professional.
Sessions involving touch or body-based exercises take place on the basis of ongoing consent. The client may withdraw consent or stop an exercise at any time.
10. Confidentiality and group safety
HAMAE treats personal information shared during the services as confidential. Disclosure will take place only with the client’s consent, where required by law, where reasonably necessary to help prevent serious and imminent harm, or in anonymised form for peer consultation, supervision or professional development.
During group activities, participants must treat everything they hear or observe about other participants as confidential. HAMAE will not use a person’s name, an identifiable client story or a testimonial for publicity without prior express consent.
11. Intellectual property and use of materials
All intellectual property rights in the materials, programme structure, methods, exercises, formats, texts, sales copy, names, trademarks, music, compositions, audio, video and other creative expressions of HAMAE remain vested in HAMAE or the relevant rights holder.
The client receives only a personal, limited and non-transferable right of use for the purpose for which the material was supplied. Without prior written permission, material may not be copied, shared, published, adapted, taught, resold, commercially exploited or used wholly or partly as the basis for a competing offering.
The client may, of course, apply their own insights and personal learning in their life and work, provided that HAMAE’s protected materials, texts, music, recordings, methods or recognisable programme formats are not copied or exploited.
12. Image, voice, music and artificial intelligence
The name, image and likeness of Elisabeth de Charon de Saint Germain, her spoken and sung voice, improvisations, compositions, music, performances, meditations, invocations, audio, video, photography and other creative or personal expressions remain the property of HAMAE, Elisabeth and/or the relevant rights holders.
To the extent permitted by law, HAMAE expressly reserves all rights relating to text and data mining, machine learning and the training, testing, development or improvement of algorithmic and artificial-intelligence systems.
Without prior, separate and written permission, protected material may not, directly or indirectly and in whole or in part:
- be uploaded to, entered into or made available to any AI or machine-learning system, dataset, model, application or platform for training, fine-tuning, analysis, sampling, cloning, synthesis, imitation or reproduction;
- be processed in prompts, embeddings, training data, model weights, voice models, avatars, music or song generators, meditation or audio applications, image or video generators, or comparable present or future technology;
- be used to create derivative music, compositions, songs, meditations, videos, soundscapes, synthetic voices, digital characters, commercial products or other output that recognisably imitates or reproduces HAMAE’s or Elisabeth’s voice, performance, image, music, distinctive language or creative materials;
- be supplied to third parties, nor may third parties be given access, permission or a licence for any of these purposes.
This prohibition applies regardless of the source of the material, including a programme, download, recording, podcast, album, website, social-media channel, performance or other publication. Access to, purchase of or permission for personal use of material does not constitute permission for AI use.
This provision continues to apply after the agreement ends for as long as the relevant intellectual-property rights, image and likeness rights, personality rights, privacy rights or other statutory rights remain in force, to the extent permitted by law. It is also intended to protect successors in title and other rights holders.
13. Recordings, screenshots and transcripts
A session or group meeting may be recorded only with the prior express consent of HAMAE and, where applicable, all identifiable participants. Without such consent, making audio or video recordings, screenshots, photographs or transcripts is not permitted.
If HAMAE provides a recording, it is intended solely for the client’s personal use. Sharing, publishing, copying, distributing, selling, adapting or using it for AI applications is not permitted without prior written consent.
14. Careful performance and force majeure
HAMAE undertakes to perform its services carefully and professionally. If performance is not possible due to illness, technical failure, a government measure or another circumstance beyond HAMAE’s reasonable control, the client will be informed and, where appropriate, an alternative or a new date will be offered. If performance becomes permanently impossible, the financial settlement will be made in accordance with the law and the agreements made.
15. Liability
The client remains responsible for their own choices and for providing complete and accurate information. To the extent permitted by law, HAMAE’s liability is limited to the amount paid out by its liability insurer in the relevant case or, where no insurance coverage applies, to the amount paid for the service concerned.
This limitation does not apply in cases of wilful misconduct or deliberate recklessness on the part of HAMAE and does not affect any liability that cannot be excluded or limited under mandatory law.
16. Amendments and partial invalidity
Additions or deviations are valid only if recorded in writing. HAMAE may amend these terms and conditions for future agreements. For an existing agreement, material changes will be communicated in good time and will apply only to the extent permitted by law and by the agreement.
If a provision proves to be wholly or partly invalid or unenforceable, the remaining provisions will remain in force. Where necessary, the parties will replace the provision concerned with a valid provision that approximates its purpose and intent as closely as possible.
17. Governing law and disputes
These terms and conditions and the agreement are governed by Dutch law. The parties will first try to resolve any dispute through good-faith consultation. If that is unsuccessful, the dispute will be submitted to the court having jurisdiction under applicable law.
